Service Contract
This agreement is made between the CLIENT (as entered in on the Intake Form) and the PHOTOGRAPHER (Christian Perkins).
1. DEPOSIT and Reserving CLIENTS session:

The CLIENT agrees to pay a non-refundable deposit to reserve their session on the specific date and time as selected during checkout. The PHOTOGRAPHER agrees to reserve the date and time specifically for the CLIENT and any other agreed upon participants only.
2. Scope Of Work:
​
The PHOTOGRAPHER and CLIENT are to arrive at the agreed upon location, date, and time. Mini sessions will be photographed at 30 minutes in length with the option to wear up to two different outfits. Full sessions are an hour and a half in length with the option to wear up to 4 different outfits. The PHOTOGRAPHER will have accessories for the clients use, the CLIENT agrees to bring their own outfits. The viewing and ordering appointment will IMMEDIATELY follow all photo sessions. The viewing and ordering appointment is 40 minutes to an hour and a half in length. The photoshoot will not exceed the given time as listed above without prior discussion.
3. Minimum Payment Amount, Upgrades, and Payment Plan Options:

3.1 The CLIENT agrees to pay the minimum amount stated during checkout, when booking their session, for their images. The minimum amount comes with a minimum amount of images, also listed at checkout. The CLIENT will select their own images at the viewing/ordering appointment the same day as their photoshoot.

3.2 The CLIENT will have the option to upgrade their collection and purchase more images which will be decided at the viewing ordering appointment. The Minimum amount as stated at checkout (when booking their session) is due the day of their session.

3.3 Any additional purchases towards images, print, albums, and additional products can be paid the day of their session via credit/debit card, cash, paypal, or through a third party option which allows for the CLIENT to go on a payment plan upon approval. These third parties include Affirm, Afterpay, and Klarna. If non of these options work, then the CLIENT and PHOTOGRAPHER can agree upon a maximum of a 6 month in-house payment plan. No images or products will be delivered to the CLIENT until the collection chosen is paid to the PHOTOGRAPHER in its entirety.

4. Cancellation, Reschedule, No-Show, Late Payment, and Non-Payment Fees:

4.1 Cancellations: The CLIENT agrees to give at least 48 hours notice of a full cancellation of their upcoming photo session without penalty. The booking fee is still non-refundable. If the client fully cancels their session without rescheduling within a 48 hour period of their upcoming session, they will be charged 50% of the session's total minimum amount due.

4.2 Reschedule: If the CLIENT needs to reschedule their photoshoot, they must give a minimum of 24 hours notice before their session. There is a one time waive of fees to reschedule the CLIENTS session. The CLIENT agrees to respond with the new date within 14 days of the time of notice to reschedule. If the client fails to respond to the PHOTOGRAPHER within 14 days from the time of notice, then the CLIENTS session will be considered canceled and they will be charged the 50% cancellation fee as stated above. If the CLIENT needs to reschedule more than once and/or gives notice less than 24 hours of their upcoming session, then the CLIENT will pay the $100 reschedule fee. The client can only reschedule twice. If a third reschedule is requested, then the session will be considered canceled and the cancellation fee as stated above will be charged.

4.3 No-Show: If the CLIENT fails to show up to their photoshoot without notice, then they will be charged the 50% cancellation fee and will no longer be able to book any future sessions with the PHOTOGRAPHER.
4.4 Late Payments: There will be a $25 late payment fee for any payments that are 14 days or more past the posted due date for payment.
4.5 Non-Payments: If the CLIENT is up to 60 days late on any payments, then it will result in being sent to collections. The PHOTOGRAPHER will give the CLIENT multiple notices before the 60 day mark of late payments, before sending the CLIENT to collections.
5. BRINGING GUESTS:

5.1 The PHOTOGRAPHER is responsible for ensuring a safe environment and privacy during the CLIENTS session. The PHOTOGRAPHER recommends to not bring anyone else to their session due to privacy and potential interruption of the session, causing the PHOTOGRAPHER to not perform their services well and causing the CLIENT to not feel comfortable during their session. IF the CLIENT decides they must have someone their with them during their session, the GUEST must be 18 or older, (NO MINORS) they must respect the PHOTOGRAPHERS work by not interrupting or giving suggestions before, durning, or after the session, and must respect the CLIENTS decision for them to leave if the CLIENT so chooses that is best. The CLIENT agrees to inform the PHOTOGRAPHER of said guest coming PRIOR to the session start time.
5.2 IF the CLIENT brings a minor to the session, they will immediately be asked to have someone else come take care of the minor, away from the photoshoot location. If the CLIENT is unable to do so within 20 minutes of the session, then the session will be rescheduled and the reschedule fee listed above will be charged. Anytime taken away from the session time will result in a shorter session for the CLIENT and all monies will still be due.
5.3 If at any time the PHOTOGRAPHER feels there is a threat of safety or privacy to anyone in the studio, the PHOTOGRAPHER has the right to immediately end the session without rescheduling and ask everyone to leave immediately . All monies will still be due.
6. Privacy of photos, videos, audio recordings during the session:

6.1 This is a private studio and again, the PHOTOGRAPHER is ensuring a safe space for everyone involved. There will be no photos, videos, or audio recordings from anyone except the PHOTOGRAPHER throughout the duration of the experience, from the time the CLIENT arrives through the time the CLIENT leaves. The only exceptions are cell phone photos/videos taken during the getting-ready for the session portion, upon the comfort of the CLIENT. The CLIENT must be asked by anyone present if these photos/videos are acceptable to be taken and only done so upon the comfort and permission of the CLIENT. This applies to and is not limited to: Hair artists, Makeup artists, Guests, the CLIENT, and so on.
6.2 Absolutely no photos or videos are allowed during the Viewing/Ordering portion of the session. The ONLY exception will be if the CLIENT asks to take a photo of any images AFTER all monies due are paid in full. If the CLIENT owes any monies, then they will not be permitted to take any photos of their images. No Acceptations.
6.3 If this portion of the contract is broken, then the PHOTOGRAPHER has the right to end the session at any time. All monies will still be due.
7. PHOTOGRAPHERS Responsibilities:

7.1 The PHOTOGRAPHER is responsible for arriving at the session at the agreed date and time. They are responsible for providing all photography equipment to properly perform their job throughout the entirety of the photoshoot experience.
7.2 If the PHOTOGRAPHER is unable to perform the services in this contract due to illness, emergency, fire, casualty, strike, unsafe environment, threat, act of God, or any cause outside of their control: PHOTOGRAPHER will make reasonable efforts to arrange a substitute photographer who is prepared to perform the services under this contract for the price agreed in upon is the PHOTOGRAPHER is unable to perform services.
7.3 PHOTOGRAPHER will return in full all payments made by CLIENT to PHOTOGRAPHER in relation to this photo session if a substitute photographer cannot be found, and if the CLIENT is unable to reschedule. There will be no reschedule fee charged in the event of the PHOTOGRAPHER being responsible for having the reschedule session. This will not count towards the amount of aloud rescheduled sessions for the CLIENT.

8. Image and Product Delivery:
8.1 ​The selected collection and image count that the CLIENT chooses at the time of their VIEWING/ORDERING appointment must be fully paid to PHOTOGRAPHER before any digital images and products will be delivered to CLIENT. Once the CLIENT agrees to the selected collection and amount of images, the CLIENT cannot downgrade the collection and amount of images chosen.
8.2 The CLIENT has the option to pay-in-full for their selection the day of their VIEWING/ORDERING appointment. If the CLIENT is able to go through third-party financing for the full amount due, the PHOTOGRAPHER is considered fully paid. If the CLIENT resorts to an in-house payment plan, the PHOTOGRAPHER is not considered paid in full until all monies are paid to the PHOTOGRAPHER at the end of CLIENTs payment plan, once all monies are paid
8.3 ​Once the CLIENT has paid PHOTOGRAPHER is full, the digital images will be delivered to the CLIENT within 10 business days, via a downloadable link to the CLIENTS email inbox. Physical products can take anywhere from 2-6 weeks to be delivered to the CLIENT once the CLIENT has paid PHOTOGRAPHER in full.
8.4 Any physical products delivered to the CLIENT past 8 weeks (from the time the owed monies are paid in full) that is outside of the PHOTOGRAPHERS control (i.e. manufacturer delays, act of God, strikes, ect) the PHOTOGRAPHER will not be responsible for the delay and will not owe any reimbursement to CLIENT. If the products are delayed past the 6 weeks due to the PHOTOGRAPHERS neglect, the PHOTOGRAPHER will offer ONE of the following: 5 free images from CLIENTS session, free hair and makeup for the CLIENTS next session, OR 2 free 8x10 print from the clients session.
8.5 The CLIENT is responsible for informing the PHOTOGRAPHER if their products and digital images are not delivered on time, if there is any damage to the products, or if the incorrect products arrive. The PHOTOGRAPHER is not responsible for any damages or incorrect products being delivered as they do come from third party print and shipping companies. The PHOTOGRAPHER WILL Request replacements from the print companies for any damaged or incorrect products delivered upon being notified by the CLIENT. The CLIENT must return the incorrect or damaged products to either the print company or the PHOTOGRAPHER if requested by the PHOTOGRAPHER and/or print company.

9. Copyright and Model Release
9.1 PHOTOGRAPHER owns all images taken during the duration of the CLIENTS session. The PHOTOGRAPHER will not share any images publicly from the CLIENTS session unless the CLIENT signs a model release, presented to the CLIENTS at the time of their session. The CLIENT is NOT required to allow the PHOTOGRAPHER to share their images publicly. It is up to the CLIENT'S discretion at the time that they sign the model release.

9.2 The PHOTOGRAPHER is not obligated to share any images from the CLIENTS session, even if requested by the CLIENT.
9.3 PHOTOGRAPHER will use the CLIENTS images, upon the signed model release by the CLIENT, as seen fit for, but not limited to: Social Media, Marketing ads, Website, Portfolio to show future clients, ect.
9.4 The CLIENT does have the right to specify what images the PHOTOGRAPHER can or cannot use during the time of signing the model release at their photo session..
